1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

3. Your Account

You can create an account using your email address and a password of your choice. You may also sign in on an additional device by scanning a QR code displayed on a device where you are already signed in. You are responsible for maintaining the confidentiality of your password and any active session on devices you control, and for all activity that occurs under your account. You agree to provide accurate information when registering, to keep your information up to date, and to notify us promptly of any unauthorized access or other security breach. We may refuse, reclaim, or rename accounts that impersonate others or violate these Terms.

4. Catalog Content

The Service provides a curated catalog of movie information — including titles, descriptions, posters, and aggregated ratings sourced from third-party databases and rating services such as IMDb and Kinopoisk — published by Kmax. The Service does not allow users to upload, publish, or share their own content within the app. Movie metadata, posters, and ratings displayed in the Service may be sourced from public or licensed third-party databases and remain the property of their respective rights holders.

Kmax retains all rights in the catalog and the editorial selection of titles. You may use the Service to browse, search, save titles to a personal watchlist, and view details for your own personal, non-commercial use only.

5. Acceptable Use

You agree not to use the Service to impersonate any person or entity or misrepresent your affiliation with anyone; to interfere with, disrupt, reverse-engineer, or gain unauthorized access to the Service, related systems, or other users' accounts; to send spam, run automated activity without our permission, or scrape or collect data from the Service in violation of these Terms; or to use the Service for any unlawful purpose.

We may restrict features, or suspend or terminate accounts that violate these rules.

6. Reporting Infringing Content

If you believe that content in the Kmax catalog infringes your copyright or other intellectual-property rights, please notify us at support@kmax.app. To help us act quickly, include:

— a description of the work or right you claim is being infringed; — the exact location (catalog item title and identifier or URL) of the content; — your contact details (name, email); — a statement, made in good faith, that you believe the use is not authorized by the rights holder or its agent; — your electronic or physical signature.

For copyright complaints, we follow a notice-and-takedown procedure consistent with applicable law, including the U.S. Digital Millennium Copyright Act (DMCA). We will remove or restrict access to content found to violate applicable rights or these Terms.

7. Intellectual Property

The Service, including its design, code, logos, trademarks, and original content, is owned by Kmax and protected by intellectual-property laws. Catalog metadata, posters, and ratings provided by third-party sources remain the property of their respective rights holders. You may not copy, modify, distribute, sell, or create derivative works of the Service or its content without our prior written permission and, where applicable, the permission of the relevant third-party rights holder.

8. Third-Party Services and Data Sources

The Service displays movie information and ratings sourced from third-party providers, including IMDb and Kinopoisk. We are not responsible for the accuracy, completeness, or timeliness of information provided by these sources, or for the content, policies, or practices of any third-party services or websites linked from the Service. Your use of any such third-party service is subject to its own terms.

9. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for Kmax, or if we discontinue the Service. Provisions that by their nature should survive termination — including ownership, disclaimers, indemnities, and limitations of liability — will continue to apply.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Kmax disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that movie information, ratings, or other catalog content is accurate, complete, or up to date.

11. Limitation of Liability

To the maximum extent permitted by law, Kmax and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD 50.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where the changes are material, provide additional notice in the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Kmax is established, without regard to its conflict-of-law rules. Where the mandatory consumer-protection law of your country of residence provides you greater rights, those rights are unaffected by these Terms.

14. App Store Distribution

This section applies if you obtained the Service through the Apple App Store or Google Play.

Apple App Store. You acknowledge that these Terms are concluded between you and Kmax only, and not with Apple Inc. ("Apple"). Kmax, not Apple, is solely responsible for the Service and its content. The license granted to you for the iOS app is limited to a non-transferable license to use the app on any Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apple has no obligation to furnish any maintenance or support services with respect to the iOS app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. Kmax, not Apple, is responsible for addressing any claims relating to the app or your possession and use of it, including (a) product-liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual-property rights, Kmax — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. You must comply with applicable third-party terms of agreement when using the app. You represent and warrant that you are not located in any country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You and Kmax acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they apply to the iOS app, and that upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Google Play. If you obtained the Service through Google Play, you also agree to Google Play's Terms of Service. Kmax is solely responsible for the Service and its content; Google is not a party to these Terms.
